To claim or not to claim

I advised a client who held a senior executive position that she had a very strong case for constructive dismissal , having been the victim of prolonged bullying by a director who was a representative of the shareholders. After a series of meetings, she took the decision simply to resign and seek new employment, which she will have no difficulty in securing. I have enormous respect for her decision because she decided that the enormous stress and emotional pressure of litigation trumped the possibility of substantial compensation for unfair dismissal. Legal advisers should always emphasise to clients, particularly individuals, that litigation is a stressful and time-consuming business and not for the faint hearted.
