More nonsense from the front line ! I have clients who are involved in highly contentious proceedings in the Derby County Court, which are themselves part of a much bigger picture. The Claimant’s solicitors forgot to pay the court fee and the trial due this coming Friday vacated. We had a witness coming from abroad and were 80% sure of winning. The solicitors, who are a large national firm, have applied for relief from sanctions and the application is to be heard in January. We would have preferred the trial to go ahead. By their negligence the solicitors have gained a huge tactical advantage-I actually wonder whether it was negligence or deliberate ? In any event, our ludicrous court procedure has played straight into their hands.
