Litigation funding -a risky business how unity can make it less risky

Roger Billins

In the first part of this blog, I examined the challenges litigation funders face in a volatile market, particularly identifying cases with a greater likelihood of success. Of course, potential claimants seeking funding suffer the mirror image of these problems-how to persuade a funder to fund a case and to persuade a barrister to give that magical 60% chance of success. Then there are the problems of picking one’s way through the market to find the right funder.

Unity can provide the right solutions for both funders and litigants to these issues. The big advantage we have is that we have no affiliation to a firm of solicitors or barristers’ chambers and, given our unregulated status, we will not be acting in any litigation for a funded client. This means that our advice whether to funders or funded is objective.

In relation to funders, we can help you assess the strengths and weaknesses of a case including challenging counsel on their opinion, interviewing the applicant and discussing the proposed strategy of the case with the legal team.

In relation to applicants, we can help you navigate the funding market, find the right funder for your case and then ensure that you put the best possible application forward to the chosen funder(s). We are happy to work with the chosen legal team or, if there are none, to identify the best people for the case.
